The lawyer representing the couple, Adam Wolanski, said the hack had caused the couple “considerable distress”.
On Sunday, the Associated Press reported that Met police had arrested a 35-year-old man in connection with the hacking after The Sunnewspaper said the hacker attempted to sell it the illegally acquired images for a minimum of £50,000 ($65,000).
He was later bailed.
The Sun said the hacker went by the name "Crafty Cockney" and claimed to possess a number of Middleton's personal photos with family, along with naked pictures of Matthews.
